*** The Inspector General at the Department of Homeland Security declined to weigh in on a brewing controversy about the legality of the elevation of Chad Wolf to serve as acting secretary of DHS and the appointment of Ken Cuccinelli as acting deputy secretary. Last month the Government Accountability Office issued a legal opinion arguing that the appointments didn't comply with the law governing succession at DHS. The GAO opinion asked DHS OIG to review their findings.

"While DHS OIG does not have a strict policy against reviewing matters that are the subject of litigation, under the particular circumstances presented it would be pointless for DHS OIG to add its voice to what has become a bitter inter-branch disagreement, "DHS Inspector General Joseph Cuffari wrote in a Sept. 14 letter to two House committee leaders. "There is no reason to believe that all stakeholders, including DHS, Congress, GAO, and private parties who object to decisions of acting DHS leadership, would accept a determination by DHS OIG on the matters referred and treat it as an enforceable ruling."

Separately, a federal district court ruled on Sept. 11 that a litigant in an immigration policy case against DHS and Wolf would be likely to succeed in pressing the legal argument that Wolf was not properly appointed to his current position.

*** The Defense Information Systems Agency is close to releasing its $11.7 billion enclave services contract, Washington Technology reports. The solicitation is an effort by DISA to consolidate a large number of IT support contracts into one vehicle that will have a single winner.
